抄録

Driven by the insistence of developing countries that multinational corporations be subject to international regulation, the international community has attempted to formulate a variety of rules. Then, after the setback of the formulation of the “Norms on the Responsibilities of Transnational Corporations and Other Business Enterprises with Regard to Human Rights”, the “UN Guiding Principles on Business and Human Rights (GP)” were born as a soft law. From these it is clear that international human rights law theory, like Japanese constitutional law theory, has recognized the problem of human rights violations by private individuals, especially corporations, and has attempted to address it with different approaches(soft law and “horizontal effect of fundamental human rights” theory). GP may lead to the maintenance of the “indirect effect theory” due to the division of roles with the GP regarding the “horizontal effect of fundamental human rights”. As the severity of the penalties and the clarity of the articles are key to the constitutionality of the implementation of GP(especially the human rights due diligence law) it is also suggested that expanding support in line with GP could lead to the effective guarantee of “the right of access to the courts”.
