本稿では，著作物としていかなる性質の製作物を著作権で保護するのか，という点につき重要な要素である 「創作性」 の解釈につき，日本及びドイツにおける現在の議論を参照する．合わせて旧著作権法下における映画・写真の保護のあり方を検討することで，これらの問題に関する示唆を求めたい．This article attempts to examine several definitions of "originality" in Copyright Law of Japan and Germany, and overviews the protections of cinematographic works and photographic in the old Copyright Law of Japan in order to clear the traditional definition of "originality".
