Laparoscopic surgery is adopted not only to diseases of abdomen such as gallbladder and stomach but also those of thorax, urogenital organs and orthopedics after the first report of laparoscopic cholecystectomy in 1990 in Japan. A frequency of operation claim with laparoscopic surgery is also increasing along with the development of the surgery. The clause for operation claim issued in 1987 does not deal with cases of laparoscopic surgery, nor has it been revised yet in spite of the great advancement of medical knowledge and technology during this decade. Even the new application rule of the clause introduced in 1992 is not suitable for laparoscopic surgery. The application of the clause to operation claim for laparoscopical surgery may blur the fundamental purpose of the insurance covering the risk of surgery. Recently, we have been requested of an operation claim with laparoscopic cholecystectomy due to gallbladder stone, and we felt difficulty to apply the operation clause to the laparoscopic cholecystectomy. The rapid development of laparoscopic surgery and the drastically growing number of patient treated with the surgical method may require us to revise the operation clause taking the recent advancement of medical knowledge and technology into consideration. Furthermore, the new clause should be retroactively enforced to policies with the present operation clause.
