デジタル化とネットワーク化の恩恵を市民が均しく享受できる社会を実現するためには、著作権法上の権利を円滑に処理することが欠かせない。特にいわゆる孤児著作物については、権利処理を複雑化させ膨大な取引費用を発生させる可能性があるため、著作物の二次利用についても電子図書館構想の実現についても、大きな障害となる可能性がある。本稿は、歌手、俳優など実演家の権利に焦点を当てつつ、それによって生じる法的課題に対処するため米国や欧州で進んでいる動きを紹介し、基本的な国際的枠組みについて検討し、わが国の取り組みと比較するとともに、さらに、近い将来に向けての政策提言を行うものである。As smooth digital rights management is a key to realize the New Digital Age where everybody can enjoy works created by other people together with the new information technology, legal matters in the copyright law are emphasized in many developed countries such as Japan, U.S. and European Union. Especially so called orphan works would make obstacles in the way of creating secondary works and accumulating legacy of human beings in digital libraries. This article provides a comparative legal study of the solution models developed in Japan, the U.S. and the European Union in light of the international framework, focusing on the neighboring rights of the singers, actors and other artists. It also provides a policy proposal which should be taken into account by the Japanese Legislature in the near future.
