Description

A 23-year-old female insured taking anticonvulsants for epilepsy was found died in a restroom of a dormitory. A medical examiner ascribed her death to an epileptic attack. The beneficiaries demanded an accidental death benefit, stating that she was killed by an assault. The previous day she was assaulted by a male inmate in a protection institution, her place of employment. Based on her medical records and references, the insurer refuted their argument by postulating that she died of epilepsy. Neither a lower court nor a higher court acknowledged that her death was accidental.
