Research Abstract

本研究は、大規模自然災害や感染症の蔓延といった広義の「非常時」における、国家による経済的助成の諸制度を整序し、この分野での今後の施策選択に資する法理論を提示するものである。そのために、災害・コロナ関連の日本における助成事例の収集・整理をし、それらの問題点を抽出し、海外における類似制度・議論も参照した上で、新たな法理論の全体像の整理と公表を行うこととする。 公法学、特に行政法学の観点から上記の作業を行い、経済的助成策全般を法的に統制するための理論枠組みを定立することを目指すのが、本研究の主眼である
