Abstract

It has been suggested in general that in eleventh-century western Europe, even royal courts had been transformed into courts of arbitration, while the public administration of justice had been drastically destroyed. In eleventh-century Aragon, however, the royal court usually tried to deliver clear-cut decisions, obeying the judicial proceedings derived from the rules of Visigothic law. In the case where a dispute should be referred to arbitration, a particular way was adopted :first of all, the royal court delivered clear-cut decision, after that, the king alone arbitrated the case without calling panels of the court, or a court organized by barones led the litigant parties to an agreement in the name of king. This is a strategy that the royal court chose to show off its authority, while satisfying actual requests.
