Abstract

The question of whether international humanitarian law includes the nature of authority to detain as a justification for security detention in non-international armed conflicts has been debated since it was addressed in Serdar Mohammed v. Ministry of Defence. This paper clarifies the difficulties of relying on implied detention authority while there is no explicit detention authority in the existing framework, and presents the conclusion of a special agreement and the formulation of guidelines as a solution applicable today.
